1. General Information

These Terms & Conditions govern participation in walking tours operated by Berlin Walk (“we”, “us”, “our”).

By booking or attending a tour, you agree to these Terms & Conditions.

Berlin Walk offers tip-based (“pay-what-you-feel”) walking tours in Berlin.

2. Nature of the Tour

Our tours are:

• Outdoor walking tours conducted in public spaces

• Informational and educational in nature

• Tip-based (no fixed ticket price unless otherwise stated)

Participants are free to decide the amount of tip they wish to give at the end of the tour.

3. Booking & Confirmation

Bookings made via our website or partner platforms:

• Live walking tour bookings made on our website require a refundable reservation deposit of €2 per guest, paid online at booking. The deposit is not a ticket price: the walk itself is tip-based and tips are separate.

• The deposit is refunded after attendance is confirmed, or if the booking is cancelled at least 24 hours before the start. The date can be changed free of charge up to 2 hours before the start; the deposit moves to the new date. For a later cancellation or a no-show the deposit is not refunded and no further charge applies. If we cancel a tour, the deposit is refunded in full.

• Bookings made via partner platforms follow that platform’s terms.

• Are considered reservations

• May be cancelled or modified by us if necessary (e.g., minimum group size not reached, extreme weather, unforeseen circumstances)

Participants are responsible for providing accurate contact information.

4. Participant Responsibilities

By joining the tour, participants agree to:

• Arrive on time at the designated meeting point

• Follow the guide’s safety instructions

• Respect other participants and public property

• Behave in a lawful and respectful manner

We reserve the right to refuse participation to anyone whose behaviour is disruptive, unsafe, or inappropriate.

5. Health & Safety

Participants join the tour at their own risk.

Berlin Walk is not responsible for:

• Personal injury unless caused by gross negligence or intentional misconduct

• Loss, theft, or damage to personal belongings

• Accidents occurring in public spaces

Participants are responsible for assessing their own physical ability to complete the walking route.

6. Weather Conditions

Tours operate in most weather conditions.

In cases of:

• Severe weather warnings

• Government restrictions

• Safety risks

We may cancel or modify the tour. If cancelled, participants will be informed via the contact details provided.

7. Limitation of Liability

Berlin Walk is liable only in cases of:

• Intentional misconduct

• Gross negligence

Liability for minor negligence is limited to foreseeable damages typical for this type of service.

Nothing in these Terms excludes liability where it cannot be excluded under German law.

8. Intellectual Property

All tour content, including:

• Spoken material

• Route structure

• Written materials

• Branding and website content

Remains the intellectual property of Berlin Walk.

Recording the full tour for commercial purposes without permission is prohibited.

9. Photography & Media

Photos may occasionally be taken during tours for promotional purposes.

Participants who do not wish to appear in photos must inform the guide at the beginning of the tour.

10. Governing Law

These Terms & Conditions are governed by the laws of the Federal Republic of Germany.

Any disputes shall be subject to the jurisdiction of Berlin, where legally permissible.

11. Changes to Terms

We reserve the right to update these Terms & Conditions at any time.
